Tacoma Renter Says Toxic Mold Her Landlord Ignored for Months Left Her With Permanent Lung Scarring, and Now She Is Suing for Retaliation Too

A Tacoma renter says months of untreated mold in her apartment left her with permanent lung scarring, and she’s now suing her landlord not just over the mold but over what happened after she spoke up about it. Melody Frazier filed a 20-page complaint on September 2, 2026 against North Pearl Street LP, the owner of the Westside Estates apartments, alleging toxic mold exposure, illegal rent increases, and retaliation through eviction threats, according to KNKX Public Radio.

Frazier and her attorney announced the suit at a press conference outside the Pierce County District Court on September 1, 2026, alongside organizers from the tenant advocacy group Tacoma For All. Frazier framed the case as bigger than her own apartment, pointing to a system that lets landlords neglect their responsibilities without consequence.

What the Complaint Alleges

According to KNKX’s reporting, Frazier’s complaint describes mold and chemical exposure that went unaddressed for months, allegedly resulting in permanent scarring to her lungs. The suit also claims North Pearl Street LP imposed rent increases that violated local tenant protection rules and failed to provide relocation assistance Frazier says she was legally owed. After she began speaking publicly, the complaint alleges, the landlord responded with eviction threats rather than repairs.

Frazier’s attorney, Ann Dorn of Nexus Legal Counsel, is representing her on contingency. Tacoma For All director Tyron Moore argued the case reflects a broader enforcement gap in how the city handles complaints against large corporate landlords.

Tacoma’s Renter Protections, and Their Limits

Tacoma has some of the more tenant-friendly ordinances in Washington state. A separate report from The Chronicle examined how those protections play out in practice, noting tenants and advocates argue enforcement often lags behind the ordinances themselves.

Mold exposure claims are notoriously hard to litigate, which is part of why Frazier’s case leans on documentation from her time in the unit rather than resting on the diagnosis alone. Lung scarring, in particular, is not something that resolves once a tenant moves out. North Pearl Street LP has not issued a public response. For a city that has built a reputation on stronger-than-average tenant protections, the case is a live test of whether that reputation holds up when a corporate landlord is the one being tested.
