Manhattan Renters Sue Blackstone Claiming Their Landlord Erased Discounts Then Quietly Raised Rent Stabilized Leases by Millions

Tenant advocacy group Housing Rights Initiative has sued Blackstone, alleging the private equity giant overcharged renters at its Frank Gehry-designed 8 Spruce Street tower in Manhattan by more than $30 million, according to reporting on the filing. The suit covers 898 rent-stabilized units and as many as 3,500 renters, current and former, dating back to September 2020.

The lawsuit names Blackstone, its BREIT Operating Partnership, the 8 Spruce ownership entity and property manager Beam Living as defendants, according to a summary of the court filing. It accuses the landlord of a specific bookkeeping maneuver: advertising apartments with several months of free rent baked in, then using the pre-discount, advertised price rather than what tenants actually paid as the baseline for calculating legal rent-stabilized increases once the concession expired.

One example cited in the filing: a unit listed at $2,960 a month with four months free, working out to an effective rent of about $1,973. When the concession ended, the suit alleges, the landlord calculated the tenant’s renewal increase off the $2,960 sticker price instead of the roughly $1,973 the tenant had actually been paying, inflating the legal baseline for every increase that followed.

Housing Rights Initiative’s filing also ties the alleged overcharges to public money, arguing the building benefited from roughly $115 million in tax credits tied to affordable-housing rules the owners are accused of skirting. The group’s executive director, Aaron Carr, has argued that landlords who misuse affordable-housing tax incentives shortchange both the city’s tax base and the tenants those programs are meant to protect.

8 Spruce Street, also marketed as New York by Gehry, is a 900-unit tower with an average monthly base rent above $6,000 and occupancy around 97% as of August, per the refinancing report. Beam Living has said it is aware of the litigation, cannot comment on a pending case, and maintains it is committed to rent-stabilization compliance. Blackstone did not respond to a request for comment on the suit.

The case adds to a running tally of rent-stabilization disputes tied to Blackstone’s New York City holdings, where the size of individual buildings means a single set of accounting practices can touch thousands of leases at once.
