Zillow’s Ban on Private Home Listings Is Moving Forward After a Federal Judge Sided Against Compass in Their Ongoing Legal Fight, and the Ruling Could Reshape How Homes Get Marketed Nationwide

A federal judge has denied Compass’s request to block Zillow’s ban on private home listings, allowing the policy to keep operating while the underlying lawsuit continues, according to Real Estate News and confirmed by both Yahoo Finance and CNN’s business coverage of the case. Judge Jeannette Vargas of the U.S. District Court for the Southern District of New York ruled that Compass “has not shown a likelihood of success on the merits,” rejecting the brokerage’s bid for a preliminary injunction.

Zillow’s policy, first announced in April 2025 and enforced starting at the end of June 2025, bars listings that are publicly marketed — through yard signs, open houses, or social media — but withheld from the multiple listing service and its IDX data feeds. In practice, that means agents can’t advertise a home for sale to the public while keeping it off Zillow and the wider MLS network at the same time, a practice sometimes called “private” or “off-market” marketing that some brokerages, Compass chief among them, had built into their business model.

Compass sued Zillow last year, arguing the company was “abusing its monopoly power” and alleging an illegal conspiracy between Zillow and Redfin to enforce the rule in tandem. Judge Vargas found no direct evidence of a Zillow-Redfin agreement, calling the conspiracy claim “merely speculative,” and was similarly skeptical of the monopoly argument, noting that brokerages still have other channels to market listings beyond Zillow’s site.

Compass CEO Robert Reffkin pushed back on the framing that the company lost, telling reporters the ruling “is not a loss” and reiterating that the brokerage has an obligation to “protect our agents from Zillow, which explicitly stated they are trying to ‘punish the agent.’” Zillow, for its part, cast the decision as a win for transparency, saying the ruling benefits “consumers and the real estate industry” by supporting “equal access to the same real estate information.”

The practical effect for house hunters is significant even though the underlying lawsuit is far from over. As long as Zillow’s rule stands, homes marketed to the public have to show up on the platforms most buyers actually use to search, rather than being shopped quietly to a narrower pool of buyers first. That keeps more inventory visible to everyday buyers searching online, but it also limits the kind of discreet, off-market sales that some sellers and agents have come to prefer. The case continues in New York’s federal court, and how it ultimately resolves could determine whether “coming soon” and pocket-listing marketing strategies have a future at all.
