Homeowners Associations Across the Country Are Quietly Banning Airbnb Rentals Inside Their Own Communities Overnight, and Investor Owners Say They Are Losing Income Before They Can Even React

Cities have spent years passing ordinances to restrict short-term rentals. Increasingly, homeowners associations are not waiting on city hall at all — they are writing their own outright bans on Airbnb and Vrbo rentals directly into community bylaws, cutting off investor income overnight regardless of what municipal law technically allows.

Why HOAs Have More Power Here Than Cities Do

Local governments regulating short-term rentals have to navigate constitutional property-rights limits, state preemption laws, and often years of public hearings before an ordinance survives legal challenge. An HOA amending its own covenants operates under a much simpler legal framework: as a private contractual community, it can generally restrict how owners use their property — including banning short-term rentals entirely — as long as the association follows its own bylaws’ amendment process and the restriction does not violate other overriding state or federal law. That makes an HOA-level ban both faster to enact and, in many cases, harder to challenge than a comparable city ordinance.

The Investors Caught Off Guard

The homeowners hit hardest are those who purchased specifically to operate a short-term rental business, often in a community that either allowed the practice at the time of purchase or had no rule addressing it at all. A board vote to amend the community’s governing documents can eliminate that income stream with comparatively little notice, leaving investor-owners to either convert the unit to a long-term rental, sell it, or challenge the ban’s legality — an option with a narrow path to success given how much deference courts generally give to an HOA’s ability to regulate property use within its own community.

States Where the Rules Cut the Other Way

The legal picture is not uniform. Some states have moved to limit how far HOAs and local governments alike can restrict short-term rentals, protecting property owners’ ability to rent out their units against overly aggressive board or city action. That patchwork means an investor’s exposure to a sudden HOA ban depends heavily on which state and which specific community they bought into — a factor that real estate advisors increasingly tell prospective short-term rental investors to research as carefully as the numbers on projected nightly rates.

What This Means Going Forward

For current owners, the practical lesson is that a community’s rules today are not a permanent guarantee, since a board vote can rewrite them with a timeline far faster than most municipal regulatory processes allow. For prospective buyers eyeing a property specifically for its short-term rental potential, reviewing an HOA’s amendment history and the current board’s stated positions on short-term rentals has become as important as reviewing the numbers the listing agent hands over.
