Google Nest Cameras Are Facing a Lawsuit Over Facial Recognition Without Consent

Google is facing a proposed class-action lawsuit that accuses two of its most popular smart home products of quietly scanning the faces of anyone who walks by, whether they knew it or not. The case, Fennessy et al. v. Google LLC, was filed June 29, 2026, and takes direct aim at the “Familiar Face Detection” feature built into Nest cameras and doorbells.

According to the complaint detailed by classaction.org, the feature doesn’t just record video of people who pass in front of a Nest device. It allegedly converts their faces into stored biometric faceprints, a process the suit claims happens without any warning to the person being scanned and without their consent. The lawsuit says this applies to anyone caught on camera, including children, and that Google built the feature to operate invisibly to the homeowners using the devices, let alone the strangers, neighbors, delivery drivers, or trick-or-treaters walking past a doorbell camera.

That distinction matters a lot in this kind of case. Facial recognition lawsuits typically hinge on whether a company obtained consent, and the plaintiffs argue there was no meaningful opportunity for bystanders to consent to anything, since most people don’t know a Nest camera is scanning their face at all as they walk up someone’s front steps. The suit, per the same report, seeks to represent a nationwide class of U.S. individuals whose faces may have been captured and stored this way.

What This Means for Smart Home Owners

Nest cameras and doorbells have become fixtures on porches and front doors across the country, marketed heavily on convenience: know who’s at the door before you open it, get a notification when a familiar face shows up on your driveway. That convenience is exactly what’s under scrutiny here. Familiar Face Detection is designed to distinguish between household members, regular visitors, and strangers, which by definition means the system has to build a facial profile of everyone it sees repeatedly, not just the people who bought the device.

Biometric privacy law has already produced some of the largest tech settlements in recent memory, and facial recognition specifically tends to draw regulatory attention because faceprints, unlike passwords, can’t be changed if they’re misused or leaked. A ruling or settlement against a company as large as Google could ripple through the entire smart home camera industry, given how many competitors offer similar face-recognition features as a selling point.

No settlement has been reached, and the case is still in its early stages. But the filing puts a spotlight on a tension that’s been building in smart home tech for years: the same AI features that make a doorbell camera useful are the ones most likely to be scanning people who never asked to be part of the system.
